Family law in California involves a wide variety of issues. While divorce, child custody, and domestic violence are the usual topics covered by the media, family law encompasses things such as:
- Alimony, or spousal support
- Child support
- Property distribution
- Marital separation
- Termination of parental rights due to neglect or abuse allegations
- Visitation rights
- Modification or termination of child support, child custody, or spousal support orders
- Drafting and enforcement of pre-nups
- Domestic partnerships
Most recently, the big divorce story in the news – besides that of Bruce and Kris Jenner – is the finalized divorce of Clint Eastwood and Dina Marie Eastwood who both appeared on a series on e! Additionally, San Diego and Sacramento family courts have begun offering “one-day divorces,” which is where a divorce can be granted to a couple literally in one day as long as the couple meets certain criteria.
Family law, however, can be complex, based on the circumstances surrounding the particular situation. For example, if a couple is getting divorced and has a lot of marital property – or ‘community property’, as it is known in California – the distribution of that property can become quite complicated based on the assets involved.
Additionally, an ex-spouse may move to modify or terminate the payment of child or spousal support. This petition for modification or termination is often met with resistance by the spouse or parent receiving the support. For a support order to be terminated or modified, certain showings must be made to the court.
